Terms of Service

These Terms of Service ("Terms") govern your use of the payment processing services, software, hardware, and related products ("Services") provided by Touch2Pay PTY LTD ("Touch2Pay", "we", "us", or "our"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating a merchant account, using our payment terminals, online payment gateway, or any other Touch2Pay service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Services on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you must not use our Services.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice. We will notify you of any material changes that affect your use of the Services.

To use our Services, you must apply for and be approved for a Touch2Pay merchant account. You agree to:

4. Fees and Payment

Our standard transaction fee is 1.4% per transaction. Additional fees may apply for:

All fees are in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise. We will provide you with a fee schedule upon account approval. We reserve the right to change our fees with 30 days written notice.

Transaction fees are deducted from your settlement amount before funds are transferred to your nominated bank account. Settlements are processed on the next business day.

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Queensland.

Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute through good faith negotiation for a period of at least 30 days.
